The Board of Directors of the Edmonds Creek Homeowners Association, Inc. (“Association”) recommends that our homeowners approve two amendments to our "Supplemental Declaration of Covenants, Conditions and Restrictions" (the "Declaration").
The first proposed amendment adds lease restrictions. Under the terms of our original Declaration that was recorded in 2018, there are no such restrictions. To the best of the Board’s knowledge, approximately thirty-eight (38) of our three hundred two (302) homes are currently non-owner occupied. Property owners, and especially owner-occupants, are naturally more invested in the community and more interested in maintaining and improving property values. With the increase of investment companies buying up homes in neighborhoods like ours we are concerned that the number of leased properties will continue to increase if we take no action.
The second proposed amendment changes the number of owners necessary to approve FUTURE amendments. Currently, for any amendment to our Declaration to be adopted, the owners of at least 70% of our homes must give their approval. Since we have 302 homes, that means that the owners of at least 212 homes must approve the amendments that we are currently recommending. Considering the fact that we've had difficulty getting even 10% of homeowners to attend our annual meetings it seems nearly impossible to achieve 70% agreement for a covenant amendment. For that reason, we recommend that the 70% requirement be reduced to a simple majority of our owners. Approval of the second amendment would set that requirement at 152 votes (just over 50%) in favor of any future amendments.
A “Town Hall” informational meeting has been scheduled for Monday October 28, 2024, at 7:00pm to be held at the Whitestown Municipal Complex (Town Hall) in the large meeting room. Please attend for a discussion of the two amendments, to ask questions you have and/or provide your input for potential final modifications. At that meeting, there will NOT be any formal vote on either amendment. Rather, the meeting will be for discussion purposes only. Following the town hall meeting the amendments may be modified based on homeowner feedback, then the final versions will be presented for a vote (voting details to follow) which is tentatively scheduled for November 11.
